Terms of Service

Please read these terms carefully before using Kuma Engine services.

1. Acceptance of Terms

By creating an account, provisioning an instance, or otherwise using the Kuma Engine platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not access or use the Service.

2. Definitions

  • “Kuma Engine” (“we”, “our”) – the PaaS offering operated by Kuma Engine LLC that hosts individual instances of the open-source monitoring application Uptime Kuma.
  • “Customer” (“you”, “your”) – the individual or entity that creates an account or otherwise uses the Service.
  • “Essentials Plan” – the base subscription tier described in §6.

3. Service Description & Shared Responsibility Model

Kuma Engine operates the underlying cloud infrastructure—physical data-centers, networking, host OS, security patching, SMTP credential provisioning, and other platform components—while you retain full control over the configuration and data inside your Uptime Kuma instance, including monitors, credentials, and API keys. You are solely responsible for how you configure and use Uptime Kuma, backing up data, and safeguarding access credentials.

4. Eligibility & Account Registration

The Service is intended for users at least 18 years old (or the age of majority in your jurisdiction). You represent that you have the authority to bind any entity on whose behalf you use the Service.

5. Subscription Plans, Billing & Payment

Pricing. Each instance is billed either (a) US $4 per month, or (b) US $24 per year (equivalent to US $2 per month) when paid annually. Charges are prepaid and non-refundable. Additional instances are billed at the same per-instance rate on the billing cycle in effect.

Auto-Renewal. Subscriptions renew automatically unless cancelled prior to the renewal date. You authorize us (or our payment processor) to charge the applicable subscription fees using your stored payment method.

No Modifications or Refunds. Subscriptions cannot be modified or cancelled once purchased, and fees are non-refundable except as required by law.

6. Essentials Plan Usage Limits

The Essentials Plan leverages shared CPU and RAM and is provided on a best-effort basis. Each instance includes 5 GB of block storage, 5 GB of monthly data transfer, and 5 000 SMTP e-mail notifications. Kuma Engine may throttle or suspend instances that consistently fall in the top 1 % of resource consumption until usage is reduced.

Uptime Kuma itself has known performance ceilings; extremely high numbers of monitors or very low polling intervals may impair operation. Kuma Engine does not guarantee performance or availability of the Uptime Kuma application codebase.

7. Service Levels

No SLA. The Service is provided on an “as-is,” “best-effort” basis with no service-level agreement. If you require contractual uptime guarantees or heightened liability protection, you must seek an alternative provider.

8. Acceptable Use

You agree not to: (i) violate any law or third-party right; (ii) interfere with the Service or any other user; (iii) upload malware or conduct penetration tests without prior written consent; (iv) send bulk, unsolicited, or deceptive communications; or (v) misrepresent your identity or affiliation.

9. Modifications to the Service or Terms

We may modify the Service or these Terms at any time. We will post revised Terms and update the “Effective Date.” Continued use after revisions constitutes acceptance; if you disagree, stop using the Service.

10. Disclaimer of Warranties

THE SERVICE (INCLUDING ANY HOSTED INSTANCE OF UPTIME KUMA) IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KUMA ENGINE’S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SUBSCRIPTION GIVING RISE TO THE CLAIM (US $4 FOR MONTHLY SUBSCRIBERS OR US $24 FOR ANNUAL SUBSCRIBERS).

12. Indemnification

You will indemnify and hold harmless Kuma Engine and its affiliates, officers, directors, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your breach of these Terms, or your data or content.

13. Termination & Suspension

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct we believe violates these Terms, applicable law, or is otherwise harmful. Upon termination, your right to access the Service ceases, but sections that by their nature should survive will survive (including §§10–14).

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-laws rules. Any dispute arising under these Terms will be finally resolved by binding arbitration administered by the American Arbitration Association in Wilmington, Delaware, on an individual basis; class or representative actions are prohibited.

15. Miscellaneous

These Terms constitute the entire agreement between you and Kuma Engine and supersede all prior agreements on the subject matter. If any provision is held unenforceable, the remaining provisions will remain in effect. You may not assign these Terms without our prior written consent; we may assign freely. Neither party will be liable for failure to perform due to events beyond reasonable control.
